Recently, Mr. Justice MacDonell of the Ontario Superior Court of
Justice struck down s. 96 of the RCMP Act regulations which creates
the management controlled Division Rep system. He found the section
and the program mandated by it to violate members rights of freedom of
association pursuant to s. 4(d) of the Charter and gave government 18
months to get things right which means giving RCMP members the same
right of choice of independent employee representation as all other
police officers in Canada enjoy. This appears to be the best way to
ensure external accountability for the RCMP by guaranteeing its
independent existence internally.
